All Nocser Technology products and services provided are subject to this TOS (Terms Of Service). Use or purchase our products or services are constitutes acceptance and agreement to Nocser Technology TOS and AUP (Acceptable usage policy) where by TOS and AUP are subject to change at any time without prior notice. By clicking on the "I Accept" button, you acknowledge that you have read this agreement and the AUP, and agree to be bound by all terms and conditions of this agreements as well as all policies and guild line of the AUP.
Refund Policy
All payment made to Nocser Technology are not refundable . This included and not limited to Setup Fee, subscription fee, Domain registration fee and all others fee you have pay to Nocser Technology. All overcharge must be report to Nocser Technology in advance before you report to the Credit Card issuer. You agree be charged $50.00 administrative fee, If you report overcharge to your Credit Card issue before inform Nocser Technology prior in advance.
Cancellation of Service
If you decide you no longer need or want your web hosting account, you may cancel at any time. To cancel an account, simply submit your cancellation service support ticket to us, and include your name, address, account username, domain name of the hosting account, and reason for your cancellation before or at the same day you receive our invoice. Our invoice will send to you 10 days before expiry date. There will be no further charges to your credit card from the time that you cancel your account provided a 10 days prior notice required . Charges already made to your credit card however, cannot be refunded.
Failure to Pay
The Company may temporarily deny service or terminate this Agreement upon the failure of Subscriber to pay charges when due. Such termination or denial will not, in any way, relieve the Subscriber of responsibility for the payment of all accrued charges, plus reasonable interest and all collection fees, including legal expenses. Or your Credit cards that are declined for any reason or Paypal payments that are either rejected or not made when Services. Your whole account will be suspended once you fail to pay any outstanding bill for more than 1 day. Once suspended, you will be charged a $25.00 suspended fee + outstanding bill to unsuspend your account. Accounts not paid in full by the due date are subject to a $5 late fee that accrues daily until paid in full. Accounts that are not collectable by Nocser Technology may be turned over to an outside collection agency for collection. If you account is turned over for collection, you agree to pay the company an additional “Collection“ fee of not less than $50.00 not more than $150.00. Charges / Fee
You will immediately pay, upon receiving an electronic invoice and before the invoice due date from Nocser Technology, all charges for your use of the Services at the then current Nocser Technology prices for that category of service or any special offer applicable to your account as determined by Nocser Technology. You will pay all charges for the first month of service in advance on the first day of the Initial Term. You will pay all subsequent charges for Services in their entirety in advance on the anniversary day of each successive month. You must pay for the Services our Payment option (Refer to Website).
Overage Bandwidth
Your package comes with allotment of Bandwidth. This represents the amount of bandwidth that you are allowed to use for each calendar month. If you exceed this allotment for any reason in any calendar month, even if you have cancelled service with Nocser Technology during the month, you will be charged overage bandwidth at a rate of $1.00 per gigabyte (Refer to Website).It is your responsibility to monitor your bandwidth usage and to pay for all overages. If you are a reseller, it is your responsibility to monitor the bandwidth usage of your client(s) as you are solely responsible for any and all overages incurred by them.
Security
You are solely responsible for any security breaches affecting servers or accounts under your control. If your server is responsible for or involved in an attack on or unauthorized access into another server or system, Nocser Technology will shut it down immediately. You will pay any charges resulting from the cost to correct security breaches affecting Nocser Technology or any of its other customers.
Disclosure to Law Enforcement
The AUP specifically prohibits the use of our service for illegal activities. Therefore, Subscriber agrees that the Company may disclose any and all Subscriber information, including assigned IP addresses, account history, account use, etc. to any law enforcement agency who makes a written request without further consent or notification to the Subscriber. In addition Nocser Technology shall have the right to terminate all service set forth in this Agreement if requested to do so as a result of any action of any law enforcement or government agency.
SPAM and Unsolicited Commercial Email (UCE)
Reporting Abuse Violations of these Acceptable Uses Policies and Terms of Service should be referred to support [@] nocser.net . All complaints will be investigated promptly. Serious violations of terms or conditions can be ground for immediate account deactivation without refund. If your site results in our IP Space being blacklisted, we will immediately terminate your account and send to collection an administrative fee of 500 USD.
Support Services and Boundaries
Nocser Technology provide support to our server issue to Share and Reseller Hosting. For dedicated server we limit our support to your server related issue included Hardware and Network. Nocser Technology does not offer technical support to application and programming such as cgi, asp, php and any other such issue. We will only support our client and reseller. For reseller's customer support is reseller's responsibility. We also not responsible for all other add-ons script or preinstall script such as fantastico, forum, Bloger and others.
Reseller Responsibility
As our Customers are ultimately responsible for the actions of their clients over the Nocser Technology service, it is advisable that Customers develop a similar, or stricter, policy for their clients.
Uptime Guarantee
Nocser Technology offer 99% Uptime Guarantee to all share hosting, reseller hosting, dedicated server and co-location server unless stated or free hosting service provided. We guarantee that the network where your hosting account resides will be "available to the internet" at least 99% of the time every month, excluding scheduled maintenance. If network uptime is not at least 99% in any given month, then you'll receive a credit for a free month of web hosting. However this is upon request. We cannot be held responsible for problems resulting from services or software running in your hosting account. Network downtime exists when you are unable to transmit and/or receive data due to problems with our network, and this downtime is recorded in our Technical Support Email system. The downtime is measured from the time your report Email is opened (by using our Technical Support request form), until the time your account is able to transmit/receive data.
Service Availability
Nocser Technology makes no guarantee of availability of service and reserves the right to change, withdraw, suspend, or discontinue any functionality or feature of the Nocser Technology service without prior notice.
Interruption of Service
Nocser Technology and its suppliers are not liable for any temporary delay, outages or interruptions of the Services. Further, Nocser Technology is not liable for any delay or failure to perform its obligations under this Agreement, where the delay or failure results from any “act of God” or other cause beyond its reasonable control (including any mechanical, electronic, communications or third-party supplier failure).
Subject to United State and Malaysia Law
The information, construction and interpretation of this agreement shall be controlled by the laws of Malaysia and the United State. Any dispute relating to this agreement shall be subject to the exclusive jurisdiction of the courts in Malaysia, and the parties agree to submit to the personal and exclusive jurisdiction and venue of these courts.
Limitation of liability
Your use of Nocser Technology's services are at your sole risk. All Nocser Technology services are provided on an "as is " basis without warranties of any kind, either expressed, implied, constructive, or statutory, including, without limitation any implied warranties of merchantability, not infringement or fitness for a particular purpose. In no event will Nocser Technology be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damage arising out of the use of or inability to use Nocser Technology's services or any content thereon. This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract, tort, or otherwise, caused by any failure of performance; error; omission; interruption; deletion; defect; delay in operation or transmission; computer virus; file corruption; communication-line failure; network or system outage; or theft, destruction, unauthorized access to, alteration of, or use of any record.
Right to Change TOS
Nocser Technology reserves the right to change or amend these Terms and Conditions at any time without prior notice. By submitting your order to Nocser Technology, you signify your agreement to these Acceptable Use Policy . If you do not agree to these Acceptable Use Policy, then please don't submit an order!
